Welcome to BitcoinMood! By accessing or using our website at bitcoinmood.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

1. Acceptance of Terms

By using BitcoinMood, you agree to:

• All applicable laws and regulations

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

BitcoinMood provides:

• Real-time Bitcoin price tracking
• Bitcoin sentiment analysis ("mood" indicators)
• Tomorrow's mood forecast (entertainment only)
• Educational content about Bitcoin and cryptocurrency
• BitcoinMood Pro (premium features, subscription required)

3. Not Financial Advice

READ THIS CAREFULLY:

• BitcoinMood does NOT provide financial, investment, tax, or legal advice
• All information is for entertainment and educational purposes only
• We do NOT recommend buying, selling, or holding Bitcoin or any cryptocurrency
• Past performance does NOT guarantee future results
• Bitcoin is highly volatile and you can lose ALL your money
• ALWAYS consult a licensed financial advisor before making investment decisions

4. Investment Risks

Cryptocurrency investments carry significant risks:

• Total Loss: You could lose 100% of your investment
• Volatility: Bitcoin can swing 20-50% in days or weeks
• Regulatory Risk: Governments may ban or restrict Bitcoin
• Technology Risk: Hacks, bugs, or protocol failures can occur
• Liquidity Risk: You may not be able to sell when you want

ONLY INVEST WHAT YOU CAN AFFORD TO LOSE.

5. No Guarantees or Warranties

BitcoinMood is provided "AS IS" without warranties of any kind. We do NOT guarantee:

• Accuracy of price data, mood indicators, or forecasts
• Uptime or availability of the Service
• That the Service will meet your expectations
• That data will be error-free, secure, or reliable

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• BitcoinMood is NOT liable for any financial losses you incur
• We are NOT liable for lost profits, data, or opportunities
• Our total liability is limited to $100 or the amount you paid us (whichever is less)
• We are NOT responsible for third-party services (CoinGecko, Google, Stripe, etc.)

7. User Conduct

You agree NOT to:

• Use the Service for illegal purposes
• Attempt to hack, disrupt, or reverse-engineer the Service
• Scrape, crawl, or mass-download data without permission
• Impersonate BitcoinMood or misrepresent your affiliation
• Spam, harass, or abuse other users
• Upload malware, viruses, or malicious code

8. Intellectual Property

All content on BitcoinMood (text, graphics, logos, code, design) is owned by us and protected by copyright, trademark, and other intellectual property laws. You may NOT:

• Copy, reproduce, or redistribute our content without permission
• Use our trademarks, logos, or branding
• Create derivative works based on the Service

You retain ownership of any content you submit (e.g., waitlist emails).

9. Third-Party Services

BitcoinMood integrates with third-party services:

• CoinGecko: Bitcoin price data
• Google Analytics: Usage analytics
• Google AdSense: Advertising
• Stripe: Payment processing (Pro subscriptions)

We are NOT responsible for the privacy practices, accuracy, or reliability of these third parties. Use at your own risk.

10. BitcoinMood Pro Subscriptions

If you subscribe to BitcoinMood Pro:

• Subscriptions are billed monthly at $15/month
• You can cancel anytime (no refunds for partial months)
• We may change pricing with 30 days notice
• Payment is processed via Stripe (we don't store credit card data)
• Failure to pay may result in account suspension

11. Refund Policy

The free version of BitcoinMood has no refunds (it's free!). For Pro subscriptions:

• Refunds are issued at our sole discretion
• Generally, no refunds after 7 days of subscription start
• Contact us on X at @bitcoinmoodapp for refund requests

12. Termination

We reserve the right to:

• Suspend or terminate your access to the Service at any time
• Remove or modify features without notice
• Shut down BitcoinMood entirely (though we hope not!)

You may stop using the Service at any time. Your obligations under these Terms survive termination.

13. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes will be resolved in Florida courts.

14. Indemnification

You agree to indemnify and hold harmless BitcoinMood, its owners, and affiliates from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and BitcoinMood. No other agreements (oral or written) apply.
